 | Monday in Denver: Ralph Ogden to challenge Amendment 71 as unconstitutional Dear Walt, You're invited to strike a win for the people Monday at a press conference sponsored by the Colorado Foundation for Universal Health Care.
Amendment 71 made it more difficult to pass an Amendment in Colorado--unless you are wealthy. Attorneys Ralph Ogden and Timms Fowler know that's not the way democracy works, so they will file a challenge to the constitutionality of A71 at 10 a.m. Monday, April 24.
*Show up at the press conference at 9:30 Monday at the Greek Amphitheater at Denver's Civic Center Park.*
Amendment 71, passed in 2016 following a misleading campaign, requires citizens who want to pass a Colorado constitutional amendment to gather a difficult-to-obtain quota of signatures from each of 35 senate districts and also win 55% of the vote.
That's so expensive as to be almost impossible for grassroots groups.
It's also unconstitutional.
Speakers from the Colorado Foundation for Universal Health care and other supporters will defend Colorado's direct democracy route, the citizens initiative, from the unconstitutional limits of Amendment 71. They'll outline why the attorneys will challenge Amendment 71 in Federal court.
Ogden is a long-time proponent for universal health care who helped write Amendment 69. He serves on the board of the Colorado Foundation for Universal Health Care.
In addition to arguing over 200 appeals in state and federal courts before his semi-retirement in 2012, Ogden successfully represented Becky Brinkman and Margaret Burd in Brinkman v. Long, the Adams County, Colorado, same-gender marriage case which resulted in a judicial declaration that Colorado's ban on same gender marriages violated the Fourteenth Amendment.

Join us this Thursday evening, December 10th, for the kick off of our health care crisis in Colorado listening tour. We'll keep the program brief so that those who wish to share their own health care access and affordability struggles will have ample time to share.

We are concerned about the many tens of thousands of our neighbors and friends who either have no health coverage or who have inadequate coverage. Having insurance you cannot afford to use is little better than having none at all. We are concerned about our neighbors and friends who had coverage through Colorado HealthOp, the ACA cooperative that was decertified, who now must try to find coverage they can afford with very little notice. We are concerned about the ever rising costs of care for all of us. In the midst of all of this concern are real people, suffering real losses and finding little relief. Many are searching for coverage on Colorado's Affordable Care Act Exchange, as the open enrollment period for 2016 coverage will close on December 15th. For many of us, there are no affordable plans, and this holiday season is filled with worry instead of wonder. Those who have the power to help make this system better don't seem to see or hear the suffering around them -- or they have chosen to shut out our voices as nothing they haven't heard before. when the Colorado Commission on Affordable Health Care was first formed, a statewide listening tour was on their agenda. But when that commission faced budgetary concerns, one of the first casualties was the listening tour. The Commissioners didn't believe they'd learn anything new from Colorado's residents who are struggling with a health care system that is dysfunctional. We know that in order to truly address this crisis, those being hurt must be heard. In 1948, the United States was part of the broad world community that supported the international Declaration of Human Rights that included health care as one of the rights declared. Eleanor Roosevelt was one of the drafters of that declaration so we know the idea that healthcare is a human right was not foreign to Americans or to residents of other countries. Since the Declaration was ratified on December 10th, 1948, we join others around the world in recognizing the 67th anniversary of that event. We believe that all residents of Colorado deserve access to a single standard of appropriate care without financial barrier, but until that goal has been achieved, we stand with our neighbors, friends and family members who suffer waiting for the day when the right to care is reality. This Tuesday, October 6th, in Denver and nationally, many health care
reform groups are coming together to object to how our country's
current health insurance system works. If you have time Tuesday, late
afternoon, there will be a great event and an opportunity to network
with other health care reform advocates. For the purpose of
this event, I think that we will be most effective by concentrating on
the health insurance industry issues and NOT bringing our single-payer
signs - general health care reform signs, HCAC t-shirts, handouts and
buttons are fine and encouraged. In the next two weeks there will be
a floor vote on HR 676, Improved Medicare For All in the US House,
however if we do not have national legislation for single-payer
universal health care this year, hopefully there will at least be a
robust public option where we can all choose to participate - if not,
our single-payer signs will get used many times in the future as we
continue with a growing number of other states working for single-payer
universal health care at the state level. I hope to see you at
the rally on Tuesday - be sure to circulate and meet as many health
care reform advocates as you can from other groups - we need each other

health insurance companies like Anthem Blue Cross Blue Shield (a
subsidiary of Wellpoint) have had a stranglehold on our healthcare
system for far too long. In 2008, Wellpoint CEO Angela Braly made $8.9
million, while Wellpoint spent $6.9 million to fight health care

National Day of Action to secure single payer universal health care in
America. All over the US our single payer friends will be rallying to
raise the attention of the nation to our cause. Please join us for

all America hear us. the morning after House adjournment. Testimony not permitted and we
have been asked to NOT bring signs, even for outside.
When
HB 09-1273 passes (hopefully) the Appropriations Committee on Friday,
the Bill may be on the House floor as early as Monday.

Hi Walt
Health Care For All Colorado has written a proposal for a comprehensive
single-payer bill inspired by the the national H.R. 676 and similar
bills in California and Pennsylvania. Bill titles for The Colorado
Guaranteed Health Care Act have been submitted by State Representative
John Kefalas and newly elected Senator Joyce Foster who are working on
the content of the bills. The HCAC bill-writing committee
included Irene Aguilar, the principal author, John Stoffel, Ivan
Miller, Elinor Christiansen, Tom Russell, Lyn Gullette and Dave Bean.
Other members of HCAC and representatives from partner organizations
also helped.
President-Elect Obama is asking you – yes, you! – to help him reform
health care in the U.S. You can sign up to host a Health Care Community
Discussion Dec. 15 – Dec. 31 at http://change.gov/page/s/hcdiscussion. Hosts
will be given special moderator kits with everything necessary to get
the discussion going. Former Senator Majority Leader Tom Daschle,
Obama’s pick for Secretary of Health and Human Services and leader of
the transition’s health policy team, will even choose one discussion to

The December 3rd hearing sponsored by Representative Jerry Frangas and
the Vulnerable Populations Committee was a huge success, with a
standing-room-only crowd of more than 200 health care reform activists.
Several legislators attended the hearing in the Old Supreme Court
Chambers at the State Capitol. HCAC Vice President Irene Aguilar gave
such a great presentation that she has been asked to give it again for
other legislators and groups.Chuck Pennachio, executive director of
Health Care for All Pennsylvania, encouraged people at the hearing to
forge ahead on a single-payer health care program. He spoke of HCAP’s
successful activities in Pennsylvania. The public was decidedly on the
side of single payer with many urging the legislature to give a
large-scale push for universal health care because of, not in spite of,
the current economic situation.
Tom Daschle, Obama’s pick for Secretary of HHS, was in Denver Dec. 7 to
attend a health care summit sponsored by Sen. Ken Salazar. Daschle
acknowledged that health care reform is one of the biggest challenges
facing the new administration, but he said Obama’s commitment to
changing our health care system was strong. Click here

questions. Daschle will be charged with devising a comprehensive
reform package after Obama takes office. T.R. Reid, the producer of the documentary " Sick Around the World,"
will address a joint session of the Health and Human Services
Committees on Jan. 8, 2009 at 1:30 p.m. in the Old Supreme Court
Chambers at the Capitol in Denver. The session is open to the public
and we encourge you to attend. Sick Around the World examines
single-payer health-care systems around the globe comparing and
contrasting what works and doesn't work for different populations.
Paul Krugman, a New York Times columnist and Princeton University
professor, was honored as a Nobel Laureate in economics this year.
Equally as important is Krugman’s stance on universal health care
coverage – he is for it. His 2005 article, One Nation, Uninsured, is a
compassionate and persuasive argument supporting a single-payer system.

Journalism Review has also launched a series on health care called,
“Excluded Voices” to bring a variety of voices into the health care
reform debate. The series is at CJR’s website.
The Columbia Journalism Review took Oklahoma’s insurance commissioner
to task for suggesting that the state take away season tickets for
Oklahoma State University games for citizens with no insurance. Not
only that, the commissioner suggested the uninsured lose lottery
winnings, state tax deductions, and their motor vehicle and hunting

Denver chapter has kept busy helping out with a mailing to over 230
doctors who are members of Physicians for a National Health Program but
have not been part of HCAC. We had seventeen chapter volunteers who
provided 80 hours of help with the HCAC Foundation donor-appeal mailing
to 2,700 people. Chapter member Lois Howard is now coordinating the
Speaker’s Bureau for the chapter. Monthly meetings for the Denver
chapter are usually on the first Saturday of the month (January will be
2nd Saturday, January 10) and we would love to see you there!

On
Dec. 8th we had a conference on HEALTH CARE TODAY AND TOMORROW. There
were three booths by agencies which are trying to help fill the cracks
in the current health care system. We also showed a series of slides
about the Health Care crisis. Then we had a panel of presenters: David
Galenda, Anne Courtright,Dr. Gary Parks,Dr. Louis Balizet, Sulsan Meri,
and William Sprouse. 38 people attended the event, and we got four new
people who are interested in our committee. There was a lively and
informative discussion. On Dec. 19 we teamed with the local
Colorado Progressive Coalition to have a Change.gov Discussion group.
There were 6 members of our group, Theresa Trujillo of the Colorado
Progressive Coalition and two new people. We had a lively discussion
and many stories were told of great need of adequate coverage and a
general consensus that single payer was the way to go.

members of the Uncompahgre Chapter met with the local League of Women
Voters to discuss combining efforts on an educational campaign for
comprehensive health care reform. Members are also working on
identifying and contacting local activist groups to organize
collaborations for lobbying and single payer support.

Scores
of chapter activists stepped to the forefront during the election
season - walking neighborhoods for candidates who support single payer,
asking questions of candidates at election forums, and writing letters
to the editor in favor of candidates sympathetic to our cause. Three of
the chapter’s single-payer advocates were returned to the statehouse!
Chapter members greeted U.S. Senate and House candidates and even the
Obama rally at CSU, with signs and T-shirts. In addition to
community educational events and "Sick Around the World" showings, the
chapter organized "Health Care as a Moral Imperative: Working for the
Common Good" for representatives of eight denominations and the
Interfaith; and Buddhist communities. These religious peoples were
gathered to examine their faiths’ traditional calls for health care
justice and to articulate a vision and message to carry into the public
arena. At the November chapter meeting, Dr. Alexandra Bernasek,
CSU professor of economics, shed light on the impact of the financial
crisis on the health care reform movement. Although some critics
comment that health-care reform efforts will be stymied, she says the

from the American automobile industry are criticized for arriving in
Washington in their corporate jets to beg for a handout for the ailing
car industry. Banks and other lending institutions fail, foreshadowing
events that lead to the Great Depression, because a house of
“questionable loan” cards has come tumbling down. Walmart is being sued
by the family of an employee who was literally trampled to death in a
“Black Friday” rush. The common thread in these events is that
these businesses put corporate profit ahead of everything else. Greed
has driven Walmart to trample on employee rights and squeeze suppliers.
Greed caused the automobile industry to create a line of unsustainably
large vehicles of such poor quality that American consumers ran into
the open arms of the foreign competition. Greed allowed our lending
institutions to lure Americans into buying homes they could barely
afford in the best of times, homes they are now losing at record rates
in the worst of times. So why should we believe that a heath
care system, driven by corporate greed, would serve us better than a
heath care system driven by compassion and financed by taxpayers? We
are shocked that a Walmart employee was trampled to death so that
someone can have that special deal under the tree on Christmas morning.
But we do a good job of turning a blind eye on the more than 18,000
uninsured Americans who die each year because corporate greed has
excluded them from getting the health care they need. In the midst of
the worst economic downturn since the Great Depression, will we open
our eyes to the unnecessary deaths of uninsured citizens when the
number of unemployed and newly uninsured Americans climbs and the death
rate goes higher? What does it take to start a revolution-- in
this case a compassion revolution? In our musings over an economy in
trouble, we have to wonder why one sector apparently untouched by bad
economic news is the health insurance industry. Has the health
insurance industry succeeded so well because they have created a
product which is so carefully marketed to the healthy that the
insurance industry's exposure to profit loss is limited? The
need for health care reform was there in the best of times. But there
is no more poignant time than right now for pressing for reform.
Increasing unemployment can only mean more uninsured Americans, but the
fear of unemployment will do much to make even employed Americans think
about how vulnerable they are to loss of health care coverage. We
have demonstrated a willingness to assist financial institutions and
industry in this crisis, but the most useful bail-out of all would be
the bail-out that gave us a single payer health care system. Think of
the consequences of that bailout. Home-owners might still have large
mortgages, but they would be uncomplicated by unexpected medical bills.
General Motors might still build cars Americans no longer want to buy,
but the cost of health insurance would no longer put GM at a
competitive disadvantage in the global market. And Walmart-- well,
Walmart would continue to fail to provide health insurance for it's
employees, but Walmart could do so with a clearer conscience. Charles
Dickens says in A Tale of Two Cities that “They were the best of times,
they were the worst of times. Our collective efforts at this critical
juncture can make this worst of times the best of times if we use
